OMG I cant believe I remembered this statute by heart! Anyhoo, are you parents aware that Minnesota Statute 181.9412 subd. 2 mandates that employers grant an employee leave of up to a total of 16 hours during any 12-month period to attend school conferences or school-related activities related to the employees child, provided the conferences or school-related activities cannot be scheduled during non-work hours. If the employees child receives child care services as defined in section 119B.011, subdivision 7, or attends a prekindergarten regular or special education program, the employee may use the leave time provided in this section to attend a conference or activity related to the employees child, or to observe and monitor the services or program, provided the conference, activity, or observation cannot be scheduled during non-work hours. When the leave cannot be scheduled during non-work hours and the need for the leave is foreseeable, the employee must provide reasonable prior notice of the leave and make a reasonable effort to schedule the leave so as not to disrupt unduly the operations of the employer. Subd. 3, states that this time does not have to be paid, but an employee can substitute any paid time off they have. This statute is very ambiguous as to if this is 16 hours per employee as a family unit, or 16 hours per child. I personally would like to believe it is per child because if someone has 4 or 5 kids, 16 hours to split is not a lot. I dont know if there is any case law that addresses this but if someone should run across a problem I can certainly find out.
