On 20 and 21 of this month, i had to attend a Seminar on IPRs financially backed and organized by WTO and WIPO. Some are thinking that Myanmar need to enact IP laws as soon as possible and IP laws are able to bring fruitful benefits for and eventually for the development of Myanmar. They believe that some flexible provisions stipulated in TRIPs agreement such as Bolar exception or so called early working, compulsory license, and parallel imports are providing in favor of LDCs. But in fact, it has pros and cons. By the virtue of TRIPs , Myanmar has been obliged to adopt the product patent regime and it have a tendency to create negative impact on pharmaceutical industry of Myanmar. Furthermore, R & D sector is almost totally lacking in Myanmar. So how to absorb the advanced technology of MNCs in these atmosphere of poor capacity building. What should we do?
