On the clear reading of agreement it was interpreted that maintenance cost shall be reimbursed, reimburse means to repay. If they had not paid then the question of reimbursement do not arise at all. but as per agreement is is written that-"(1) the Facility Manager shall operate, manage and render specified day to day services with regard to the Common Portions and the Complex Common Portions, (2) the Facility Manager shall levy and collect the Common Expenses/Maintenance Charges, (3) the Buyer shall be bound to pay the Common Expenses/Maintenance Charges to the Facility Manager, (4) the Facility Manager, being a professional commercial organization, will not be required to render any accounts to the Buyer and it shall be deemed that the Facility Manager is rendering the specified services to the Buyer for commercial considerations and (5) the Facility Manager shall merely be the service provider for rendition of specified services with regard to the Common Portions and the Complex Common Portions and no superior rights with regard to the Common Portions and the Complex Common Portions shall vest in the Facility Manager". As per these clauses it is interpreted that facility team is keeping some part with them might be as salary or other. Amount of money charged by them shall be taken into the account and its validity. Also this paragraph explains that facility team dont have any superior right, it means committee may decide which vendor shall work here and who shall be paid what amount.
