Our community has been engaged in active discussion about a potential process to re-establish, through the federal rulemaking process, a government-to-government relationship with Native Hawaiians. The public has the opportunity to share manaʻo BY AUGUST 19 regarding whether the federal government should keep the door open to establishing a process that Native Hawaiians could use, if they choose later, to pursue a form of federal recognition. This rulemaking has the potential to provide stronger protection for existing Native Hawaiian assets, rights, resources, and programs. It could also greatly expand Native Hawaiian self-determination, by creating a pathway that could lead to a government-to-government relationship with the United States. Federal law currently makes this possible for the indigenous peoples of other states, but not Hawaiʻi. OHA is strongly supporting the creation of such a process, as long as it DOES NOT diminish Native Hawaiians rights and claims or hinder Native Hawaiians from pursuing other pathways. It is possible to open the door to see what can be negotiated with the federal government and continue to seek other international pathways of redress.
