Over the years formation of a new Society has become complicated and is full of bureaucratic hurdle.This notes is being made to reduce possible harassment at the later stage. The following are basic steps required in the formation of a new society: Decide on the Geographical area of the Society. In many States, there are different Registering Authorities based on the Geographical area of operation of the Society. For District levels Societies is done by Society. For District levels Societies is done by Registrar of Societies at District Level, whereas for operation beyond a District Registration is done by a State Level Authority. Decide on the name of the Society. The name of the Society should be such that it is not similar with any other Society operating in the area. Decide on the members of the Governing Council. In some States a Minimum Members are required for the Governing Body (Typically-7) and Members (Typically-21). Full details of such members including full residential address, name of the father passport size photo, the date of birth etc should be obtained and kept. In Orissa, even it has been prescribed that there should be a minimum of three witness. The First Resolution of the society should be a resolution to form a Society and the name, area of operation and objective of the Society should be clearly spelt in this resolution.All the Members including governing council members should sign in this resolution. This should be written down on abound register so that it can serve as a Minute Book and Permanent Register. Attendance Register should be invariably kept and the signatures of the members attending the meetings should be obtained on this register. There are few clauses which are required to be put into the Memorandum and Rules & Regulations by virtue of the state Law and existing practice as being followed by the authorities. In Orissa one of such clause is empowering the District Administration to order audit of the accounts and to take over the Society extreme case. Such Clause should be ascertained from the District Social Welfare Officer and should be included in the Memorandum. If possible, a copy of the Memorandum and Rules & Regulations of a recently formed Society should be obtained and studied for this purpose. Printing of the Memorandum should be deferred till the Society is finally registered as changes can be imposed by the Registering Authority. Four copies of the Memorandum should be signed in original and witnessed. The photocopy can be taken which should be duly certified as “True Copy” on each of the page by Secretary of this Society with rubber stamp. Even the Society does not have anything to report, a Cash Book and Ledger should be prepared and kept. Rubber Stamp for the President, Secretary and Treasurer should be made and put wherever these officers are signing. Round- seal can also be prepared. Once these documentation are ready, the registration procedure should be started. This requires filing of the documents with the Registrar of the Society. In Orissa, the following steps are required for this:- This document sent to the Local Municipality office or Block Development office who Certifies that their exist no other society by similar name in the area. This does not require any inspection of the Society by the Officers. However, a visit is normally made to ensure the actual existence of the Society. It is also appropriate to make and put a sign board of the society at the office of the society. Once the report is submitted by the officer regarding no objection in approving the name further report is sought from the District Social welfare officer regarding the genuineness of the society. Such officer will normally visit your Society and will look into the activity of the Society such as Minute Book, Account Book etc. On completion of the inspection, the District Social Welfare officer will give no objection certificate to the Registering Authority. After this verification, the Registering Authority will recommend to the D.C OR A.D.M., for the approval of the Society. On receipt of approval the Society is registered and Registration Certificate is issued. After Registration of the Society, you should proceed to register the Society with the Income Tax Authorities U/s 12A and Section 80G or any other applicable Section. In case, you have a Project approved by the Foreign Donor Agency, application for prior permission under FCRA can also be submitted. The objective of the Society is such as to give benefit of the work carried out by the Society to the people at a large in respective of Caste, creed or Religion.
