Ahl ul-Halli Wal Aqd And Declaring The Khilaafah Ahl ul-Halli wal Aqd is an important aspect to discuss in relation to the establishment of the Khilaafah. It is an important aspect to how the Prophet (saw) established the first Islamic State and it is also important to discuss due to the current confusions surrounding the topic as they (the confusions) are acting as preventions for the Muslim Ummah to give Bayah to the current Khaleefah, Aboo Bakr ul-Baghdaadiyy (ha). It is agreed that the normal way to appoint a Khaleefah is by consulting Ahl ul-Halli wal Aqd. However, many people are confused as to who exactly are Ahl ul-Halli Wal Aqd and who is eligible to be from them. The confusion has led to many believing and choosing their own Ahl ul-Halli Wal Aqd and thus rejecting the Khilaafah because those whom they considered to be from Ahl ul-Halli Wal Aqd were not consulted. One must understand who exactly Ahl ul-Halli Wal Aqd are and not include those who are not eligible to be from them as this would be a cause of disunity amongst the Ummah with an invalid basis and reason. Who Are Ahl ul-Halli Wal-Aqd? To understand who the Ahl ul-Halli Wal Aqd are, we must look to the very first Ahl ul-Halli Wal Aqd that existed in this Ummah. From studying the Seerah we know that they were from the people whom the Prophet (saw) accepted Nusrah from – the people from the tribes of Aws and Khazraj. These were the Sahaabah who are described as the Ansaar and the Ahl ul-Halli wal Aqd were the leaders, influential and representatives of the whole Ansaar whom the rest of the Ansaar would obey in their decisions. What Is Nusrah And What Are The Conditions of The Ansaar? To understand who are eligible to be called Ahl ul-Halli Wal Aqd, one must understand a little about the Prophet’s (saw) activities regarding seeking Nusrah and why the Aws and Khazraj got accepted while other tribes were rejected. Seeking Nusrah It was after 10 years of Dawah to the Mushrikeen in Makkah that the Prophet (saw) was seeking out the help from people who have military power. He (saw) was seeking this to secure a land for him so that he (saw) can establish the Deen of Allaah on a state level. This is called seeking Nusrah and those who gave this Nusrah are called Ansaar. He conversed with tens of tribes around Makkah, some of whom were from Banoo Haneefah, Banoo Shaybaan, Banoo Saleem, Banoo Hamdaan, Banoo Nasr, Banoo Aamir ibn Sasaah, and others.
