PIL filed in HC for total implementation of Human Rights Act => A Public Interest Litigation has been filed in the Jammu and Kashmir High Court seeking directions to the government to comply with the Protection of Human Rights Act, 1993, for safeguarding of human rights in the state. The PIL filed by Inam-un-NabiSoudagar son of Ghulam NabiSoudagar of Hubby Colony Lal Bazar through advocates Irshad Ahmad and Raja Aamir wants government to approve independent budget, infrastructure support for the State Human Rights Commission, and appoint Commission members, in line with the requirements of the Act. Besides, the PIL seeks directions to the government to create a separate and autonomous investigative agency that willassist the SHRC in the investigation of human rightsviolations. “The SHRC may be directed to cease the practice of usingpolice officers to investigate complaints and touse only officials capable of producing an unbiased investigation,”says the PIL. It has also sought government to institute effective record-keeping schemes that will make the SHRC accountable for their obligations to investigate. The PIL also made six other prayers for corrective steps to implement the provisions of the Act. “The SHRC may be directed to make publicly available theinformation by way of the Right to Information Actand establish and maintain a thorough, accurate, and up-to-date website that complies fully with the statutory mandates of the Protection ofHuman Rights Act, 1993, and the Right to Information Act, 2005.” It also seeks directions to government to release the Commission’s annual reports and publish their ownaction-taken reports in response to the Commission’s reports, in a timely manner.
