PLEASE READ THIS!!!! Hi Anne I thought of another way to try to explain the point that I am unsuccessfully trying to make to you. If someone dumped wet mouldy carpet that was not recyclable or recoverable in a place meant only for recoverable or recyclable materials; would that person get prosecuted? To be consistent with your modus at Owaka you would not prosecute the person, but instead, copied from your email below:- you would have:- “…. conversations with our Senior Environmental Health Officer confirming the kind of testing we should be seeking, what firm we should be using for this testing and what kind of results we should be looking for. We have also spoken with Hills Laboratory to gather their views on the best analytical testing for the MDF carpet material. We had engaged PDP to undertake the testing programme. It has taken some time to agree to the costs associated with such testing and the type of testing that will be undertaken. The testing will involve obtaining a representative samples of the MDF carpet material and testing it for a suite of 8 heavy metals, semi-volatile organic compounds (SVOC) and total cyanide. We want to understand the effects from the presence of any of these elements on the site and in terms of any processing/recovery type activities. PDP are a New Zealand-owned environmental consultancy specialising in Air, Water, Land and Environmental Management - and you can learn more about them at pdp.co.nz/index.cfm .. PDP use their Environmental Scientists to undertake this kind of work. We are now awaiting the results. Timings for this are contingent on how quickly the samples can be analysed at the laboratory and the report write up to follow…..” Do you now see the point I am trying to make Anne? To copy another bit from your emails below, would you really need … “To instigate compliance/enforcement action I need to have evidential sufficiency which means that I need to independently make my own assessments.” Really ? surely not. The chemical make-up of the MDF or the carpet don’t matter; if it is not recyclable or recoverable it doesn’t comply? What has the pit owner advised the Council his MDF recovery/recycling purpose/process is? Has the Council asked the pit owner this question? Please respond. Thanks Colin
