PRESS RELEASE 22.8.14 Planet Key heading to Court The Electoral Commission has refused to reconsider its advice that the song and music video Planet Key are election programmes under the Broadcasting Act and election advertisements under the Electoral Act. The satirical music video has now been deleted from internet video sites and iTunes has been instructed to remove the song. The creators of the works, blues musician Darren Watson and motion graphics creator Jeremy Jones, say that they felt they had no choice but to remove the song and video from the internet because they were not prepared to add a promoter statement to their work, but do not believe the Commission is right in its approach to the law. They will be challenging the Commissions advice in the High Court because they see its stance as an infringement of their right to freedom of expression. The mens lawyer, Wendy Aldred, says that there is a concern about the chilling effect the Electoral Commissions interpretation of the legislation could have on musicians who wish to make political comment through their music. Sam Scott of the Phoenix Foundation says that silencing any New Zealand artist because they have political opinions in an election year seems like the opposite to democracy if you ask me. >>>> ends
