PRISONERS AND A SENSE OF THE LAW It came to me in news that some prisoners led by a prisoner on death row has dragged the Independent National Electoral Commission to Federal High Court for the Court to determine if the Commission has a right in law to deny prisoners the right to vote in elections in Nigeria as a right given them by the Constitution and the African Charter on Human and Peoples Right. They also want, amongst other things, for the Court to order the Commission to be registering prisoners for elections and be providing voting centres in prisons during elections. I think this is very interesting and possibly one of the best things to happen in litigation in Nigeria.Even in US and UK I dont think their courts have witnessed this kind of highly legalistic litigation. My only worry is,assuming the court will decide in their favour, how long will the number one plaintiff who is on death row;waiting in prisons for the hang man to do his job, live to be voting in elections?
