PROTECT MANHEIM NEEDS YOU! 1) Express Natural Gas CNG Compressor/ truck filling facility is anything but natural! For those of you who have not yet gotten clarity on this issue, consider this: at this time Natural gas exploited in both Canada and the USA is FRACKED out of our Earth, The process of “Fracking” contaminates our air, water and soil without any of our consent. Please see the award winning documentary movies “Gas land” 1&2 by Josh Fox . As of 2012 over 50% of the gas in the Iroquois pipeline is “Fracked “Gas from Canada. New federal regulations are being placed on pipelines due to the issue of Methane leakage- up to 17% reported and ever increasing due to aging of lines and changes in climate disturbing pipelines not designed for deeper reaching frost, earth quakes, and the ever challenging issue of human mismanagement. Raw Methane is over 80 times more effective than CO2 at trapping heat, thereby accelerating global warming and climate change. NYS has a de-facto moratorium on the permitting of High Volume Horizontal Hydrocracking, known as “FRACKING” because of health, safety and environmental concerns. The vigilant action taken by concerned individuals and institutions such as our Basset Hospital, and local town boards who have placed zoning bans or have criminalized the process of fracking and its related activities preventing a detriment to both health and property values . Explosions are a very real concern as well and can be triggered by cell phones or a car ignition. Also if the dew point is high methane will not continue to rise but may sit about 10 feet above the ground. The Manheim ZBA and planning boards approved the XNG CNG Facility which will produce CNG by drying, compressing and cooling the “Fracked” Gas drawn from the Iroquois pipeline. Toxins will contaminate our air, our farms; our and all life will be negatively impacted if one considers the process from beginning to end it is dirtier than coal and uncontrollably dangerous. That means Truck accidents! XNG has rolled two trucks within two years of business. Manheim facility will be capable of filling 8 trucks every 1 ½ hours but at this time XNG estimates 45 trucks per day max, peeking in winter. XNG trucks will be delivering within a 200 mile radius! Approximately 1600 tons of fracked Gas will be expressly delivered daily from your neighbors in Manheim. They will travel primarily down I67, around “Dead Man’s Curve and over the Wind bridge” onto the thruway. Expanding Supply of fracked gas by producing a usable form of CNG, repackaging it, and delivering it will have the effect of increasing fracking everywhere, Canada and the USA. The addiction is enabled! The plan is to reverse the flow of the Iroquois pipeline and deliver the gas to export terminals for global distribution & to expand Fracking of the Pa and NY shale’s. The Gas Industry’s profit will dramatically increase at our expense. “Start Up NY” will offer XNG ten years of NO Sales Tax, property tax nor Business Tax! That is not all Federal subsidies will offer #10,000.00 per truck to convert from diesel to in this case “Natural” Gas, cleaner burning BUT more deadly and dirtier than coal from cradle to grave. Every well will forever remain a portal for the upward migration of toxins, they can never be resealed……over 48,000 ghost /abandoned wells in NYS alone!!!! Our DEC Commissioner Valarie Washing was fired for bringing up this issue. SO WHAT WENT WRONG IN MANHEIM? Local Law # 1 was unanimously passed again 6/2013 in Manheim. John Haughton town supervisor well versed in the dangers of HVH Fracking remains opposed to Fracking, BUT refused to file the Law after XNG had entered the equation. First Haughton claimed he had requested filing of the law…..but had later discovered it had not been done, and refused to file it after discovering the “error”, blaming author and special counsel David Slottje for the error. David not only denied never having received a request to file but demanded in person that it now be filed as required by law. The blame game went on while XNG ‘s dollars were applied to attorney Ayers representation of Manheim Town ship for the ushering in of the Compressor /Truck Facility. Ayers stated that the Local law should not be filed and that it would not apply to this project , later in another heated board meeting in May of 2014 he went into an executive session to give legal advise to the town of Manheim, and came out with a resolution throwing out the Local law ( that had never been filed) . The resolution was based on a particular set of circumstances experienced by a township that felt it was an emergency to pass a similar law, skipping certain procedures that eventually rendered their town’s law invalid because they had bypassed running it by their county planning board as would normally be done. The NYS Home Rule law giving townships the right to pass such zoning laws was upheld at the appellate court level shortly after Ayers and Manheim Board issued their confounded resolution without a public hearing! The Manheim ZBA apparently did not believe the Engineers, Health professionals, toxicologists and numerous concerned citizens opposing the approval of this project based on concerns for Heath, Safety, and obvious misinterpretation of zoning code for the Ag 60 zone which XNG a fracked Gas Industrial Facility and producer of an explosive fuel would place in a residential / agricultural zone next door to a farm, an animal clinic, stores and homes. The ZBA concurred with Ayers that “CNG was coming out of the pipeline, going into the trucks and CNG was coming out of the trucks.” XNG was not producing CNG Fuel” which is explicitly prohibited for the Ag zone. Production of explosives is prohibited and though CNG is can explode it was not intended to be an explosive, so this two was irrelevant. We should all be shocked at this betrayal! At the misinterpretation and misapplication of zoning law e should recognize the need to defend our neighbors from this Danger being imposed on them without consent. We should realize that we are all going to be in danger because this Fracked Gas Industry has rolled Manheim Town over and allowed NYS to enable Fracking to which we are regionally opposed. Please Join the Protect Manheim Group to block via Article 78 an injunction to stop XNG and the Town of Manheim from building this Compressor /truck Facility, before we suffer the detrimental effects Fracked Gas industrialization brings to small towns. 8 dangerous jobs with a high risk of Vibrational acoustic disease are not that attractive, and remember if you smell methane and you will, a cell phone or starting your car to escape a potential explosion could be the trigger that ignites the methane…..pipelines explode, there are two pipelines adjacent to the Newswanger farm, one built in 1929 and the Iroquois built in 1992. Please ask yourselves who you know that can contribute to the financing the Injunction now needed to stop the Compressor/ truck facility from being born by Manheim and Little Falls. We need $50,000.00 to pay our attorney. And we have 15 Days from Monday the 10th of August to get it together……this when weighed against all the EXPLOSIVE detrimental potential that will manifest if no action takes place.
