PURPOSES FOR A NEW CONSTITUTION 01) To place fundamental rights at the core of the constitution and make them the focus of the protections it provides; replace ‘social justice’ with plain ‘justice’. - Define what separates ‘rights’ from ‘privileges’ - Describe fundamental rights of individuals - Define what actions government can and cannot take to impair rights (to protect the accused, especially prior to conviction) while ensuring that justice to those harmed is not diminished 02) To confine government authority and action to enumerated and explicit powers only; create and maintain a decentralized and lean structure of government organization and operation. Positively identify the purposes, roles and functions of government. - Restore and strengthen “checks and balances” - Enumeration: discrete (quantified) authority with clearly defined boundaries - Explicit: interpreted as worded; lacking hidden or secondary meanings; implied power prohibited - Governance at the lowest possible level (decentralized authority). - Revenue system that functions on an attrition basis (fee-based, with un-utilized services diminishing of their own accord) - Laws with the broadest applicability are the most difficult to approve (reach back) - Genuine government transparency 03) To provide for, and promote a social and political environment favorable to public participation; provide substantive means for individuals to influence legislation without devolving to “mob mentality”. - Define what separates autonomy from citizenship - Autonomy (sovereignty) by default; citizenship by compact - Much broader civil powers (voting, initiative, referendum, recall, dismissal, disbandment, nullification, set-aside, etc.) - Promote prominence of “town hall” decision making processes; provide mechanisms for sound dispute mediation processes 04) To structure the government around the concept of “society by compact”; create a framework of law that emphasizes adherence to the principles of mutual agreement—socially, politically, and economically. - Emphasis on decision and agreement by compact, contract, covenant, and accord - Citizenship as privilege – qualification and compact; benefits and obligations - Criminal cases constrained to mala in se infractions - Civil cases primarily constrained to contractual disputes - Free market economy (laissez faire) under open-transaction model 05) To eliminate or minimize systemic ambiguity by defining terms and concepts within the constitution itself. Promote law that is “user friendly” while simultaneously retaining technical fidelity and integrity. 06) To redefine the nation’s role and relationships amongst the other nations of the world with emphasis on political non-intervention, military non-aggression, and economic non-exploitation. - Prohibit government action and influence on political structures of foreign States (no nation building) - Prohibit preemptive military activities (including invasions). No “world’s policemen”, no “regime changes” (or even assistance for such)! - Disincentivize the exploitation of cheap foreign labor markets. Incentivize domestic production through appropriate application of trade tariffs. - Prohibit foreign ownership of American territories and business entities (corporations) 07) To accept and process the realities of human behavior, while simultaneously nurturing common idealisms for human behavior. Reassert guiding principles of ethics and morality by encouraging leadership through example. Restore ‘good’ virtue to both society and those who represent that virtuous society in the government.
