Peterson v state of florida,983 so.2d 27 (fla 1st DCA 2008) stand your ground,florida criminal rules of proceedures3.190(b) rather than (c)(4) is more appropriate as all defenses available to defendant by plea should be made by motion to dismiss .. Motion to dismiss is not subject to 3.190(c)(4) but by 3.190(b).the court is to reconcile any factual disputed and may not deny a motion to dismiss simply because a factual dispute exists. The court never followed the law, never got the facts correct to make a lawful ruling. Ruling off fraudulent information written by the court is "Fraud of the court" a crime of its own.
