As a secular democracy, India should be no different from the US, Canada, Australia, etc. where the law of the land is equally applicable to everyone regardless of their faith. Unfortunately, that is not so. The Government of India openly and systematically discriminates against a section of its citizens for the simple reason that they are Hindus World Hindu Organization (WHO), on behalf of one and half billion strong international Hindu fraternity, vehemently opposes discrimination against Hindus in India. WHO strongly demands a Uniform Civil Code in India which will foster social justice, national integration, sectarian harmony & religious freedom. We appeal to all concerned, to denounce this ongoing discrimination against Hindus in India. The term civil code is used to cover the entire body of laws governing rights relating to property and otherwise in personal matters like marriage, divorce, maintenance, adoption and inheritance. As things stand, there are different laws governing these aspects for different communities in India. Thus, the laws governing inheritance or divorce among Hindus would be different from those pertaining to Muslims or Christians and so on. The demand for a uniform civil code essentially means unifying all these personal laws to have one set of secular laws dealing with these aspects that will apply to all citizens of India irrespective of the community they belong to. Though exact contours of such a uniform code have not been spelt out, it should presumably incorporate the most modern & progressive aspects of all existing personal laws while discarding those which are retrogressive. * What does the Indian Constitution say on the subject? Article 44, which is one of the directive principles laid down in the Constitution, says: The State shall endeavor to secure for the citizens a uniform civil code throughout the territory of India. As Article 37 of the Constitution itself makes clear, the directive principles shall not be enforceable by any court. Nevertheless, they are fundamental in the governance of the country. Widespread support for Uniform civil code: 1. Supreme Court of India Favors introduction of Uniform Civil Code: Supreme Court of India regretted the non-implementation of a Uniform Civil Code while hearing a petition pertaining to the Indian Succession Act. Delivering its verdict, 3-judge bench regretted that Article 44 of the Constitution had not been given effect to even after over 50 years of independence. ==> [Article 44: under the Directive Principles of State Policy, Reads - State shall endeavor to secure for the citizens a uniform civil code throughout territory of India.] ==> [Article 14: Equality before law - The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.] We would like to state that Article 44 provides that the State shall endeavor to secure for the citizens a Uniform Civil Code throughout the territory of India, It is a matter of regret that Article 44 of the Constitution has not been given effect to. Parliament is still to step in and frame a common civil code in the country. A common civil code will help the cause of national integration by removing the contradictions based on ideologies.” Justice Khare, Justice S B Sinha and Justice A R Lakshmanan passed separate orders agreeing with Chief Justice V N Khare. 2. President APJ Abdul Kalam: President APJ Abdul Kalam threw his weight behind the campaign for the enactment of a uniform civil code. He has justified his stance by saying that a uniform civil code was essential for a country like India with a billion people, as any law has to be uniformly applicable. 3. Dr. B R Ambedkar: Dr. Ambedkar unequivocally endorsed uniform civil code to strengthen the Indian Republic. He strongly felt that a consensus on the population policy was not possible due to lack of a uniform civil code resulting in imbalance in population. He also maintained that until 1937, the Muslims were governed by the Hindu Law.
