Planning Board-PH Zoning Bylaw Changes Monday, July 08, 2013 7:30 PM Town Hall NOTICE OF PUBLIC HEARING TOWN OF MENDON In accordance with MGL Chapter 40A Section 5, a continuation of a Public Hearing will be held on Monday, July 8, 2013 at 7:30PM in the upper level of the town hall to see if the Town will amend Zoning by-laws by: Making the following changes: 1.Correct omission of article number, delete title, and rename as Article III Use Regulations. 2.Rename Article IV, Business District as Article IV, Site Plan Review; 3.Delete Section 4.01. Zoning By-Law Amendments: 1.Section 1.02 (a) Definitions, delete Section 1.02 (a), the definition for Accessory Use of Building, and replace with the following definition: Accessory Use or Structure. An accessory use or structure is subordinate to the principal use of land and/or structure: 1. Whose use is customary in connection with the principal use of land and/or structure, and 2. Whose use is clearly incidental to the principal use of land and/or structure, 3. Which is located on the same lot with the principal use of land and/or structure, and 4. Which does not constitute a conversion of the principal use of land and/or structure to one that is not permitted. 5. No use that is prohibited shall be allowed as an accessory use. 2.Section 1.02 (g), delete in its entirety. 3.Section 1.02 (o), delete in its entirety and replace with the following: Piggery: All buildings, structures and/or pens used specifically to shelter and maintain pigs. 4.Add Section 1.02,(v) Power Plant: A building or buildings housing machinery, dynamos, and associated equipment necessary for the generation of electrical power, exclusive of wind energy turbines and large-scale ground mounted solar voltaic installations. 5.Delete Sections1.05 © and (d) in their entirety. 6.Delete Section 1.06 ( e), (f) and (g) in their entirety. 7.Delete Section 2.04, Non-Conforming Structures, in its entirety. 8.Delete Section 2.05, Prohibited Uses, in its entirety. Making changes to the following section: Section 3.01 – Uses of Land and Structures Add Section 3.05 Accessory Dwelling Units Add Section 3.06 Inclusionary Zoning By-law The Public Hearing will be held at the Mendon Town Hall, 20 Main St. Mendon, MA. Copies of the proposed amendments will be available for reviewing at the office of the Town Clerk, Mendon Town Hall, 20 Main Street, Mendon, MA and at the Taft Public Library, 18 Main Street, Mendon, MA 01756.
