Presidents Message: I wish to report on some fantastic events that we have had in the past month. Our Birthday dinner held at Gordon Biersch Restaurant was a success. Our speakers were Pam Legge- of BB& T - speaking about her experiences as a member and past president and on a different note, Mechelle Wilson- of Alliant- our California Young-New Professional of the Year spoke on her new experiences and involvement in IAIP and our great local association. For those of you that were unable to attend, hope to see you at our November meeting On a different note, in order for our association to grow, we need to mentor our Young-New Professionals in the industry. Encourage your work associates to become involved in SDAIP. Not only do we provide great industry net-working, education opportunities, but we participate in sponsoring some great charities such as Grossmont OPT and Rachels House just to name a few. Our YNP Team of Mechelle Wilson, Dawn Manzano and Jennifer LeRoy, put together a wonderful mixer event on October 28th at 57 Degrees. We had a total of 42 attendees. Great networking and socializing time for all. Our YNP Team will be having this event quarterly. Look for our announcments in your email of upcoming events. Remember, our Board Meetings are open to all members as well as our General Meetings. If you ever have any questions, please feel free to contact me. Rachels Schedule Thank you to everyone who signs up to serve lunch at Rachels Womens Center. If you dont get the schedule that I send, asking for volunteers, please let me know so that I can add your email address to my distribution list. Volunteering at Rachels is a great way to start your weekend. Working side by side with other members, or bringing your friends and family members to volunteer with you, is a rewarding experience for everyone. SDAIP teamed up with the Alzheimers Association and put their best foot forward on Saturday, October 18th in Balboa Park at the Walk to End Alzheimers. Team SDAIP was able to raise over $725! Thank you to everyone for your support and contributions to this very worthy cause! In November SDAIP will be giving back to our two favorite charities: OPT Program (Office Professional Training) and Rachels House. We will have speakers Dr. Mary Leslie from OPT and Antoinette Fallon from Rachels House and each will be presented with a check. In addition we will have a paper goods drive for Rachels House at our November meeting the following is the list of items needed Napkins Paper Towels Paper plates Paper bowls Plastic food handling gloves (not rubber gloves) Plastic utensils - forks, knives, spoons Garbage bags Feminine products And of course any toiletry items are always needed ie: shampoo, conditioner, body wash, deodorant, razors, etc. In December we will be donating childrens toys to Shriners hospital (Los Angeles and Tijuana hospitals) and even if you cannot make the December meeting you can always bring your toys to the November dinner meeting. Sometimes all we need is a little encouragement to attend a meeting or get involved. In fellowship, Juliette Gamini Ways and Means- Pam Legge GLOW GOLF SDAIPs 7TH Annual Glow Golf Tournament is scheduled for Friday, February 27, 2015. We are looking for sponsorships, goodie bag contents, and of course golfers! Our sponsorship partners are a huge part of the success of the tournament. Without their financial assistance, we would not be able to make the generous donations to OPT and Rachels Womens Center during the holidays. The Event Sponsorship is $1200 and includes a Deluxe Foursome and company name & logo on future e-mail blasts. The Dinner Sponsor is $900 and includes two Deluxe tickets, with name and company logo on e-mails. Additional levels are: Registration, $500; Drinks, $350; Flashlights: $300; and there are 9 Hole Sponsors available at $200 each. We are also looking for a Bag Sponsor: a company that would be able to donate the bags we fill w/ goodies for the golfers (as well as any contents we can put in the bags). Sponsors will also be listed on a Sponsorship Board at the event and posted in our bulletin. It is sure to be another huge success! Education - Jari Sutton Have the Flood Talk During California Flood Preparedness Week With severe drought in much of the state, many are hoping for rain. But when the rain finally comes, your clients could have a whole new problem on their hands-flooding. After an extended period of drought-like conditions, flooding is more likely to occur because the dry ground cannot easily absorb rainwater. Flood risk is amplified by the charred, barren land left by the wildfires that raged through many parts of the state during the past several years. Flood risk will be a topic of discussion throughout the state during California Flood Preparedness Week, which begins Oct. 20. Talk to your clients about their specific flood risk and ensure they are covered with flood insurance. Many people think about flood insurance only when a major event occurs. But typically there is a 30-day wait before a policy goes into effect, so the time to act is now. Statewide, about 1.4 million people live and work in high-risk flood areas. But they are not the only ones at risk for flooding. Nationwide, more than 20 percent of all National Flood Insurance Program (NFIP) flood claims are for properties located outside of mapped high-risk areas. All clients should know that just a few inches of water can cause tens of thousands of dollars in damage. FloodSmart, the marketing and education campaign of the NFIP, provides the Cost of Flooding tool to help clients visualize the amount of damage flood water can cause. Also use the FloodSmart Flood Risk Scenario tool to help show your clients how they might be at risk for flooding. More free resources to help talk about flood risk and sell flood insurance are available at Agents.FloodSmart.gov. Legislative - Katie Freeman California Imposes Civil Liability on Businesses for Subcontractors Employment Practices On September 28th, California Governor Jerry Brown signed Assembly Bill 1897, which imposes new risks on businesses who use subcontractors as a source of labor. Historically, a subcontractors employee who asserted claims against the subcontractors client for labor code violations had a difficult time demonstrating an employment relationship with the subcontractors client. Under the new law, any business using workers hired through a labor contractor in the normal course of business becomes automatically liable for the labor code violations of the labor contractor, including the accompanying civil penalties. The law could have far reaching effects for businesses that rely on subcontractors to provide workers. As written, the law could apply to any business that retains a subcontractor to supply labor that is even tangentially related to the business activities. Thus a construction company or office complex that hires a subcontractor to supply security guards could be liable for that subcontractors failure to page wages or failure to provide workers compensation insurance. A few key exceptions limit the laws impact. The law does not apply to businesses with a total workforce of less than twenty-five workers or businesses with five or fewer workers supplied by a labor contractor. Also, the law only holds the business liable for the subcontractors wage and hour violations and the subcontractors failure to secure workers compensation insurance. Businesses would not automatically be liable for the subcontractors violations of the other provisions of the Labor Code, such as the Codes whistle blowers provisions. Furthermore, subcontractors employees who are exempt from wage and hour laws are unable to use the law to impose liability on the subcontractors client. The first line of defense for businesses that rely on subcontractors for their workforce is to review their agreements with their subcontractor to confirm that those agreements include indemnity language that covers violations of the labor code. The new law explicitly allows a business and its labor contractors to enter into such indemnity agreements. The next line of defense is to exercise a greater degree of oversight in the subcontractors employment practices by demanding evidence of the subcontractors compliance with wage and hour laws, as well as evidence of sufficient workers compensation insurance. Businesses must now be especially wary of subcontractors who claim they are exempt from following the Labor Code because their workers are independent contractors as opposed to employees. Given the steep penalties associated with misclassifying employees as independent contractors, companies considering doing business with these subcontractors should confer with legal counsel to determine if there is a bona fide independent contractor relationship between the subcontractor and its workers. Young Professionals Mixer - Dawn Manzano First Young Professionals Event Mixer, Tuesday October 28th, 2014 at 57 Degrees Wine Bar Thank you to everyone who came out to our first Young Professional Event Mixer. We had a fantastic turnout which included 40 Young Professionals in attendance. It was great to have everyone interact and connect with others in the Insurance Industry. We also collected some completed SDAIP new member applications. We have decided from last nights event, we definitely need to continue having these networking functions. We will be planning the next event so make sure to look for details in your emails.
