Protect the Dogs - Protect the Owners. The Courts Allowed a Shooter to Abuse again...Will it be another Dog or a Human Who Loses their Life next? Please support our efforts to Protect the Dogs and Owners! What happened at Court on Wed., Oct. 22, 2014? First of all, we got many thumbs ups from passing motorists for being out with signs in front of the courthouse. My sign which read, Officials Weak On Animal Crime even got an applause. This tells me many citizens are fed up with Officials regarding the status-quo in Weakley County, Tn. Okay, now for the court update: The location of the hearing was moved without notification to Boomers family. It was moved to the jail. The shooter, Tommy Martin, was seen pointing and laughing while driving by the courthouse. We went to the jail location and waited nearly 4 hours for the case to be heard. Strangely, Tommy Martin seemed to know when his case was to be heard and only entered the location about 15 minutes prior. Was he told what time, or called when near time? Or does he have ESP? We dont know. The outcome of the case is as follows: 1) The Judge informed the guardian of Boomer that the State refused to take the case. The guardian was not notified ahead of time that this was the DAs decision, so they could not get representation or prepare their case! 2) The Judge stated the charge against Tommy Martin was the wrong statute. This charge was written by the Deputy, and not stated to the Deputy by the complainant at the time the charge was filed. So, it is puzzling how or why this happened. However, the Judge seemed to be blaming the complainant, from my perspective. 3) The Judge went on to inform everyone that shooting a dog was theft of property and nothing more, and in effect, the penalty for that was restitution equal to the amt. of the dog, i.e., mutt, puppy, old dog, prized coon dog. In my opinion, that speech, and the way he presented it, seemed to be telling everyone within earshot that it is okay to shoot and kill dogs without any, or much of any consequence. He seemed patronizing when telling Boomers guardian that it was easy to research the correct statute, and went on to inform Tommy Martin about his rights to file charges against this family for dogs who get on his property (Boomer was not on the shooters property when Tommy shot and killed him. Boomer was on his own property,according to the witness), so why the Judge seemed to side with Tommy Martins story is unknown and baffling. Especially since the family of Boomer did not get the opportunity to present their side, and there was no trial for the Judge to have come to that conclusion or Judgement. Of course, these are my views based on my observations. 4) The case was dismissed with Prejudice, meaning that it can be brought back to court with a new charge with the correct statute The Judge said the guardian of Boomer would have to retain an attorney [at the guardians expense] since the State (District Attorney/Prosecutor) will not take the case. Events since this hearing: 1) An attorney has been consulted. A further update about this will be posted once I am at liberty to provide one. The issue of which statute is the correct statute is being looked into as well. 2) The Weakley County Press is planning to publish a story on this case and the events on Tuesday, Oct. 28th, 2014, according to the newspapers editor. 3) The shooter continues to shoot into this familys property. The dogs are having to be tethered until the privacy fence can be constructed which is NO life for dogs...even with that...the shooter is shooting at them. There is a very high risk of harm t o the remaining dogs and the humans. There is no justice, there is no law enforcement...there is just us. Law enforcement has failed miserably to protect this family, as has the court so far. This is not over! Updates will be posted as they become available. Ty to everyone for your ongoing support.
