Q: Have you ever wondered why Korean adoptees who were illegally adopted have never sued in a Korean court? A: We cant because the statute of limitations expires by the time we are old enough to know what happened to us. In other words, if we wanted to sue, we should have done that when we were children, according to the law. However, not everyone agrees that the statute of limitations should be applied to adoptions. In fact, one law professor at a Korean university argues that our cases should be heard in Korean courts. Please join Soongshil University College of Law Professor Daniel Edelson for a seminar on his paper: FOR THE WORLD’S MORE FULL OF WEEPING: WHY SOUTH KOREA SHOULD RETROACTIVELY ABOLISH CIVIL AND CRIMINAL STATUTES OF LIMITATION IN CONNECTION WITH ILLEGAL INTERNATIONAL ADOPTIONS. Step A (for now): This seminar will focus simply on why our cases should be allowed to be heard in court. Step B (to be done the future): After the publication of this paper in English, TRACK would like to publicize the paper along with its Korean translation amongst Korean lawyers and judges, and then work with adoptees and Korean parents to test a case.
