Question 11a of the Federal Background Check Form 4473 or Brady Check asks the purchaser if s/he is the actual transferee/buyer of the firearm being purchased. The SCOTUS ruled today that the purchaser can not truthfully/lawfully answer yes if the firarm is intended for another...regardless of the others ability to purchase a firearm him/herself. ie - Buying with the intent to give a firearm as a gift to mom, uncle Freddie or grandma is not legal despite the purchaser knowing that the giftee is entirely eligible. The ruling says that Straw Purchases do not merely include buying a firearm with the intent to transfer it to a person known to be barred from firearm ownership...buying for a good guy is not legal either. If you want to buy a gun for someone- that person must do the final 4473. At OTP weve always acted with this assumption just to err on the side of safety.
