REFUTING THE FACEBOOK FUQAHA FI JIHAD - The stance of the classical scholars of Ahl as-Sunnah, regarding the prohibition of killing women and children in combat. Today we have many saying it is permissible to target women and children in warfare deliberately, due to their blind allegiance to people or groups. ------------------------------------------------------------------------------------------------------------------------- Ibn Qudaamah al-Maqdisi (RH) said: And do not kill, from them (the enemy), a child, the clinically insane (majnun), a woman, a monk, an old man, a sick individual confined to their bed (or chronically ill - zamin), or a blind person. [Al Umdah] Imam ash-Shawkani (RH) said: And the narrations of this chapter prove that it is not permitted to kill women and children. Those that forward this stance are Imām Mālik and Awzai. For both of them it is not permitted to kill either in any situation, even if the people of war (Ahlul Harb) shield themselves with women and children, or fortify themselves in a fortification, or if they are upon a ship and have placed with them women and children it is not permitted to catapult them or to burn them out. The Shafii and Kufan jurists (i.e. the Hanafis) combine all of the narrations and state that if a woman attacks you, it is permitted to kill her. [Nayl al-Awtaar, Volume 5, Page 460] Imam Subki (RH) said: (A Muslim soldier) may not kill a woman nor a child soldier unless they are in combat directly, and they can only be killed in self-defence. [Al Nawawi, Majmu, 21/57] Imaam an-Nawawi (RH) said: The scholars are at consensus to act upon the Hadith of the prohibition of killing women and children as long as they do not fight - But if they fight, then the majority of the scholars say they should be killed. [Sharh Sahih Muslim, 12/48] Ibn Hajr (RH) said: And all (the scholars) are agreed, as Ibn Battal and others have narrated, upon the prohibition [Mani’] of intentionally killing women and children”. [Fath Al-Bari, 6/146] ------------------------------------------------------------------------------------------------------------------------- May Allah forgive the few scholars who came to an error on this issue and said it is permissible to directly target them in revenge attacks, even if the women and children are not harming the Muslims or fighting them. However for the bloodthirsty overzealous juhaal who seek every excuse there is to do such things, misinterpreting a hadith about the night raids, and ignoring the proofs against it, have a dangerous attribute of the Khawarij, most notably the al-Azariqah sect who slaughtered the subjects, women and children etc. of the person/group who they made takfir of. -- via People Of The Sunnah Adam Ali Abu Mujahid Abu Hafs Abu Essa Fahad Ishtiaq Sayf Ibn Adam Bodrul Amin Waseem Khan Taleb Al-Dean Abu Muhammad Abu Bakr Umar
