The Commission directed the Under Secretary to ensure that the appellant to whom Government did not give him the pay scales even though his juniors were given these pay scales, is fixed in the appropriate pay scales by the Government at the earliest and arrears of pay are also paid to him. The commission further directed that the Secretary (Education), Government of Puducherry may expedite the appellant’s case and inform the appellant accordingly within six weeks of receipt of this order. Shri H. Abdul Hadi, the appellant has filed this appeal dated 10.7.2012 before the Commission against the respondent Directorate Motilal Nehru Government Polytechnic College, Puducherry for non-compliance of Commission’s order in case No,. CIC/RM/A/2012/000233/LS dated 5.6.2013 relating to his RTI-request dated 7.3.2012. The matter came up for hearing on 07.08.2013 at Puducherry. The appellant was present whereas the respondents were represented by Dr. S. Udayakumar, Principal/FAA and Shri V. Passoupatih/HOD/ECE. RTI can help you get your Pay The Commission vide its order dated 5.6.2013 in case No. CIC/RM/A/2012/000233/LS held as follows: “The matter, in short, is that the appellant was a Lecturer in Civil Engineering in Moti Lal Nehru Government Polytechnic, Puducherry. He retired from service in 2003. It is his contention that he was eligible for pay scale of Rs. 10,000/- to 15,000/- as on 1.1.1996 and that of 12,000/- to 18,300/- w.e.f. 1.1.2000 but Government did not give him the above mentioned pay scales even though his juniors were given these pay scales. During the hearing Shri M.N. Gunashekharan, US, Deptt. of College Education informs the Commission that the appellant has a good case. The Commission directed the Under Secretary to ensure that the appellant is fixed in the appropriate pay scales by the Government at the earliest and arrears of pay are also paid to him. This order may be complied with within eight weeks time. In compliance with the directions of the Commission in the aforementioned case, Shri M. Gunasekaran, Under Secretary (Education), Chief Secretariat (Education), Puducherry vide letter No. 2067/Edn. Sectt/E-11/2011 dated 2.8.2013 informed the Commission that the proposal to fix appropriate pay scales and arrears of pay in respect of Shri H. Abdul Hadi, Senior Instructor (Retd), Motilal Nehru Government Polytechnic College, Puducherry is under process/examination of the Government subject to fulfillment of conditions governed under AICTE norms/CAS scheme.
