Race To The Apex Court! Four appeals before Supreme Court The Supreme Court is now set to decide on the four appeals before it over the appeal court judgment on the Ondo state October 20 Governorship Election which upheld the victory of the State Governor, Olusegun Mimiko. Already, the Action Congress of Nigeria ,ACN, Peoples Democratic Party ,PDP, and their candidates, Rotimi Akeredolu,SAN, as well as Olusola Oke respectively have earlier filed their appeals challenging the Appellate Court ruling which struck out their appeals. Ironically, despite being declared winner by the lower courts, Mimiko and his party have also filed an appeal at the Supreme court challenging the Appeal Court for throwing out some paragraphs of their grounds. The Appeal Court had queried the tribunal for basing its judgement on the fact that the Voters Register issue was a pre-election matter, saying it was not a pre-election matter, but not substantial enough to call for fresh election. Mimiko and LP, are now appealing against the exercise of Jurisdiction by the Court of Appeal on issue of voters register. Also, the Independent National Electoral Commission,INEC, has approached the Apex Court appealing against the Court of Appeal’s verdict that it did not comply with the Electoral Act in compiling the voters register used for the controversial election. Confirming this, ACN Counsel, Titiloye Charles said the main appeal was filed by ACN/Akeredolu and PDP/Oke praying the Supreme Court to order for a fresh Election in the state. However,a Human Rights Activist, Bayode Ogunmola saw Mimiko, LP and INEC cross-appeal as necessitated by the need to widen the scope of issues to be decided by Supreme Court beyond opposition parties’ appeals. He said the supreme Court will therefore have to decide the status of a voters register used for an Election, whether an Election Tribunal can look into its validity or not.
