Re: (ESA) Appeal to the Tribunals Services Ref: SE834141B/125018 Date: 07 March 2011 In the beginning I would like to express my genuine gratitude to all who are dealing with the case of my involuntary resignation from the position of Teaching Assistant (EAL deapartment) at St Marks Academy, Mitcham, on 19 April 2010. I would like to appeal on British Benefit Offices, Investigative and Legal - Judicial Bodies. Please, let all who are investigating this senive and high profile case related to St Marks (period of 2008 – 2010) and who are gathering or evaluating evidence (include medical evidence) let they do it on the basis of objective truth in accordance with all investigative and legal rules so as to avoid any kind perversion of the Noble Cause of justice. As I have already mentioned, the matter concerns a sensitive and high profile case related to St Marks Academy during the period of 2008 – 2010 under leadership of Ms Esther Holland (Associate Headteacher) and Mr Peter Evans (Executive Principal). At St Marks Academy during mentioned period there had been committing serious violations of: • EU Employment Law (The European Employment Directive) which is implemented also in the UK legislation • Health and Safety at work Act 1974 and EC LAW • The visa policy of the UK Despite of my predominantly positive teaching - supporting experiences (TA) at St Marks Academy unfortunately last more then 12 months I was witnessing and also personally experiencing some unfair practices from the side of my superior (Ms Jessie Spenceley), which surely do not belong in a Christian school and into the UK - a country which was and still is for me the symbol and GREAT example democracy – since my childhood. I have been aware of all the difficulties that St Mark’s school was facing at that time and the urgent need of improvement for the sake of the students - their academic and personal development - as well as for a good Ofsted Report. One of the appropriate and crucial policies for positive change is to have well qualified and professional teaching staff. It is up to the management of any school to make the good and fair decisions in the matter of human resources. I am concerned about the policies I witnessed and experienced during the last 12 months. I doubt whether they were correct and benefited the students of St Mark’s Academy. Some good and highly skilled staff members were dismissed. I am concerned by this fact and also by the manner in which the dismissals were carried out. In some cases I am concerned about abuse of power, violating human free will and dignity, the values of Truth and fairness. I feel that unfortunately the methods and practices used in same cases remind me of those typical for THE COMMUNIST TOTALITARIAN REGIME and THE GREAT PURGE. It is really sad for a Christian school, which has to be build on Jesus Christ, on the GOOD NEWS, LOVE AND JUSTICE, when school is rewarding some of its own QUALIFIED, RESPONSIBLE, HARDWORKING and OUTSTANDING members of the teaching and support staff with forced resignations, which were often obtained by unjust evaluation of their work performance by some superiors, as well as covert, sophisticated and systematic long-term verbal and emotional bullying. In some cases I have concern regarding true motivations. After several years I realize that there are various reasons for a purge. In the Stalin time The Great Purge had been orchestrated by persons who decided to take action against potential rivals or threats for leadership of the Party. St Marks Academy in the period of 2008 – 2010 had been really creative and it had been keeping relatively busy communication with UK Home Office regarding Work Permits for non EU staff, despite the fact that current global economics crisis has caused, that current job market offers a sufficient supply of British and EU qualified people.
