Recently, the 83rd Texas Legislature enacted SB1702 / Repeal of Alternative Certification which effectively “kicks the can” down the road for bringing substandard structures up to building code compliance. What the Alternative Certification Program did was provide a phased approach to building code compliance over a period of years, so that critical components of structures could be brought into compliance gradually, rather than homeowners being burdened all at once with full building code compliance. However, when the exceptions outlined in SB1702 terminate after December 31, 2015, all structures must have a certificate of compliance (WPI-8) for construction occurring on or after January 1, 1988. If nothing is done by the next legislative session, homeowners will then be faced with the burden of post-construction certification of their structure if they do not already have a WPI-8 certificate of compliance.
