Sept 10, 2014 To whom it may concern: This letter is to address the total willful and intentional sabatoge of my case by the greeley office of the colorado state public defender. Including the following actions that have occurred: #1 the greeley office of the Colorado state public defender did discriminate and mock myself on my initial vist to them due to my disabilities and my pain I incured in climbing 42 stairs to their office. When I called their office and the leasing office attempting to obtain accommodations both told me that I had to get up to the office - since that is what the court ordered me to do. So I forced myself to get up the stairs - resulting in tremendous pain to myself. Upon getting up there the office staff visibly laughed at me for my discomfort. In direct violation of the ADA - I was chastized for my disability and for requesting accomidations. #2 I then filed a formal complaint with both the Colorado office of civil rights (a dept within DORA) and with the United States Dept of justice - civil rights commission regarding the greeley office of the Colorado state public defender actions. I also lodged a complaint with the state office - which the state office has completely and totally refused a response. #3 upon meeting my public defender for the first time in court a Stephanie cotton - she basically threatened that I was going to take the deal or I was going to jail. I did not take the deal. #4 due to the above issues and the offices treatment of myself with complete and utter malice I requested a alternative defense counsel be appointed. At this same time I have and still have pending notice of claims under crs 24 regarding other actions by the state office and by other branch offices of the public defender for their conduct. I also have had 4 meetings with the Colorado supreem court office of attorney regulation involving attorneys from the state office of the Colorado state public defender. I was denied alternate defense counsel. #4 every other case I have had to contend with in other counties - alternate defense counsel has been appointed. All of those cases justice was accomplished. This is the ONLY TRIAL I LOST. #5 Kevin STROBEL and stephine cotton ignored my multiple attempts to discuss my case and come to agreement on how to move forward. #5 kevin strobel did not answer my questions, did not provide competent counsel in the hearing he handled that permitted the grandson to testify. It is my belief that he did this intentionally in an effort to silence my demand to be involved in my defense. Thereby allowing the jury to be preudiced by clearly coached testimony. In direct violation of my right to equal protection under the law and my right to due process. As well as my right to perticipate in my defense. #6 kevin strobel, stephine cotton and the greeley office of the Colorado state public defender did repeatedly refuse to allow me to participate in my own defense, and repeatedly deny my requests for information and to answer my questions regarding my case. #7 the above named Colorado state public defenders did refuse to contact all witnesses I wished to call on my behalf. Including the paramedics, the er tech who pulled the glass out of my head and gave the bottle of glass to my now ex wife, and last but not least my ex wife who was willing to testify to my injuries and condition. Again, dening me the ability to present a defense. #8 the above named Colorado state public defenders did deny my ability to present my written medical records in my defense, as they never obtained them even though there were signed releases. Again, completely denying me the ability to present a defense. #9 shortly before trial I had someone offer to pay for a specfic defense attorney to try my case. The understanding was that the public defenders office had done all of the leg work. They had done none. Again dening me the ability to present a defense. #10 the trial commenced and my attorney was severly disadvantaged due to the complete lack of prep by the public defenders office. He declined to allow me to present witnesses, nor evidence in my defense as I clearly pointed out during my own testimony. Including mentioning the glass pieces in the bottle from the hospital. #11 upon being convicted - my attorney withdrew. And so I again went back to the public defenders new office. Where again they treated me with utmost disdain. #12 the day of the scheduled sentencing my now new public defender wanted to meet. And I met just a few hours before. She was animate that I just go forward - yet there were alot of issues I saw with where things were at, including a scripted and blatantly incorrect psi report saying that I had no ties to the community and no community support structure. She finily agreed to requesting a continuance to address the list of issues. #13 during the time between being convicted and the sentence date I had been recieving a ton of threatening phone calls from weld county Sherriff deputies. Statements like we are going to shut you up permanently. as well as several of my community supportors were physically threatened by the sherriffs dept. In addition others recieved phone calls directed at discouraging them from testifying for me. None of these actions were addressed by my defense council even after several of those being threatened went to their office to report the threats - she still did nothing. Then myself and two of those who had been subject of the threats and hostile actions by the sherriffs dept amounting to point blank witness tampering, went to their offices. While we were meeting with Samantha grover and her investigator kevin strobel came in. When I brought the fact that his office had done nothing to address the threats to his attention - he immediately accused me of being the only one claiming witness intimidation. yet to my right and two my left were witnesses seeking help and protection from the threats by weld county law enforcement. I accused him of lieing as witnesses were sitting right there and several had been to his office the previous day. He forcefully told me to leave and that I was to never come back to his office. This is yet another attempt to deny my right to competent counsel and to deny me the right to participate in my defense. #14 Samantha Grover clearly lied to my self and several of my supportors. By stating she had not recieve the letters of support, yet the supportors were being harassed by law enforcement for writing them. This is also a clear and unmistakable violation of attorney client privilege. She repeatedly denied getting the letters and repeatedly ignored my corrispondence regarding those same letters. Some of those who wrote letters asked that I withdraw their lwtters due to the conduct of ms grover and of law enforcement in regards to their own safety. #15 Samantha Grover did fail to have the appeal filed imeadiatly at sentencing as she stated she would in multiple emails and messages between myself and her and between her and some of those who supported me. She new full well of my concerns for my well being at the hands of the sherriff and my on going sever medical issues- yet acted in a way to ensure my immediate detention and harm comming to me. Her conduct borders on fraud - a clear and intentional misrepresenting her intentions in regards to me health safety and wellbing. #17 the judge clearly showed his bias and malice for myself when he stated that I had not brought the denial of witnesses and evidence up during trial - when I clearly did from the stand during my own testimony. Samantha grover failed to represent me and address this and other statements made during the hearing. Including by parties who are currently involved in civil litigation where I am pursuing them for their denial of my civil and constitutional rights under the color of law in federal courts. #16 I was subject to clear and willful cruel and unusual punishment due to samanthas willful and intentional misleading myself and ensuring my incarceration I was denied medical care by the jail. The medical staff at the jail stated that they were not able to get my attorney to verify my medical condition, nor the doctors whom I have been seeing. As a result their actions served to compound my pancreatitis and cause sever unimaginable pain to my self for an extended period of time. I was denied medically nessessary diet and treatment for my pancreatitis, my traumatic brain injury, my knee and my back. All done out of sheer malice and knowledge that pancreatitis will turn fatal if not treated and managed. When I brought this up on my call to the lawyer she openly stated that my health issues are not her problem. Again, showing a clear lack of moral ethics or any other kind of humanity whatsoever. Upon being released I went to the hospital twice in less than a week due to the extreem severity and unending intense pain. #17 samantha grover did refuse me the right to call witnesses at my sentencing hearing - openly and willfully. I had a witness present who could refute some of the claims via their 1st hand knowledge of the animals and damage to the property that was used against me at that hearing. I was denied the ability to call those witnesses. #18 I was in route to court last thursday as required I began throwing up large chunks of blood and more pain than had been. The person bringing me took me to the hospital and I was treated for my pancreatitis and told that my pancreatitis was now causing me to have concerning issues with my kidneys. I was ordered to bed rest - and to return to see a doctor the following day. Samantha was made aware and was provided documents from the hospital showing that I was there. She failed to act and a warrant was issued for my arrest with no bond. Again her actions and refusal to be moral and stand up for my interests resulted in even more problems. #19 I have been emailing and calling my attorney of record Samantha grover daily since last thursday when this started. She has failed to address or respond to my concerns about my sever health issues and total lack of medical care in jail. Again stating that my medical issues are not her concern. She has also contacted law enforcement with the information I have shared regarding my need for ongoing treatment - in direct violation of attorney client privilege, and is completely unethical under any circumstances. Her actions have made me convinced that she desires me dead than to get the nessessarry treatment for my current condition. #20 when I contacted the Greeley office of the Colorado State Public Defender yesterday - I was told that I could not have representation with out a phone number where Samantha could call me back. Due to all that has happened - I no longer have a phone to be called at. No where whatsoever does it state that a citizens right to competent counsel be dependent on their possessing a telecommunications device of their own. This statement clearly show that this office is biased, and has a great deal of malice towards myself. This is socialeconomic discrimination and open and blatant denial of counsel. Due to the clear and blatant evidence listed above it is appearant that the Greeley Office Of the Colorado State Public Defender has handeled my case unethicaly and has a clear conflict of interest In Seeing me endure additional cruel and unusual punishment at the courts and sherriffs hands. It is my firm belief that the ongoing actions and in actions are designed to end my life. The Greeley Office of the Colorado state public defender has clearly violated United states code title 42 sec 1983 as well as title 18 sec 241 - 245 and believes that this is ok to cause the type of harm that has come to me as a direct reault of their actions. Under the law due to the greeley office of the Colorado state public defender total lack of ethice, their malice and intent to do me harm I am entitled to an alternative defense counsel. I hereby request one imeadiatly as my health depends on it.
