Sherry Jones Please consider legislation (Nicholes Law) that allows for Grandparents Rights to recognized without the stipulation of going to court in those certain circumstances related to the death of a parent or in cases where temporary custody may be with another individual as currently stated in statutes.laws/tennessee/title-36/chapter-6/part-3/36-6-306. In the event of a dispute with the custodian, please provide provisions to seek immediate resolution using mediation by an approved TN Family Court Mediator or hearing to minimize trauma to children. Additionally, may this great state of Tennessee recognize grandparents that have met these criteria as having rights prior to DCS intervention, safety placements, placement in a foster care situation as an immediate option for care until a court determines otherwise. Save our children. Save our families. Nichole Burk As I read this, I understand a grandparent has rights prior to going to court. Others seem to think a petition must be filed first. The general public and many attorneys are not aware that grandparents have any rights at all. DCS violates grandparents rights in many instances. The definition of a grandparent should be recognized in the event of a death and with regard to DCS to include a foster parent of a child that ages out of DCS custodys child if that relationship meets the above stated criteria and the relationships are established during extended foster care or following aging out of custody.
