Since the new Newtok council insists on funding an attorney with either UPC or NNC funds for a scope of work yet to even be defined..., If the IBIA decides the BIA overstepped its authority to recognize a council elected under questionable circumstances ... Then the question for the community is: What authority did this private group have to allow them to commit the tribe to liabilities to the Newtok corporation. If indeed the IBIA doesnt acquiesce or sends the issue back to the BIA for further clarity of their selection of council from the Newtok village, then it seems the group calling itself the new council has no binding authority for agreements or a recognized council to bind the council to liabilities such as funds borrowed from UPC or the Newtok Corporation to fund their fun.... Their attorney isnt going to graciously refund the new council if the Council isnt affirmed .... I suggest the Newtok membership prepare forms of reimbursement for the new council since their knowledge of the appeal was known to them and they chose to ignore the appeal and proceed to attempt to bind the Newtok village in agreements and liabilities when in fact they has no legal standing with the Newtok Village, were not recognized by the BIA and funded by a rouge DCRA .... Fascinating .... If the old council had the backbone and interest if the community they claim .... It would be in their interest to begin a positive campaign if and when a community election is required and to seek restitution from the new council members individually since sovereign immunity is specific to tribal councils and not private tribal members? Attorney time .... ?
