Staring at the ceiling at the hotel where I was staying in Hong Kong last night, my mind was not occupied by the proposals which had been accepted and signed by Presidents of HSMC and NTPU, hopefully, in the best interests of both faculty members and students from both institutes--my major duty to exercise on this business trip--but, rather, by the current situation in the Legislative Yuan and other occupied places in Taiwan where different voices or conflicts have been heard and eye-witnessed. Frankly, as a professor of negotiation and communication, I have been quite frustrated and even quite sad recently about what has happened until now. It appears that all of the latest stances have indicated a no-winner negotiation outcome. Still, to me, no communication, no negotiation. Communication should be based upon the Transactional Mode, (契合式的溝通) rather than Actional Mode or Interactional Mode, in which each party involved always begins the communication by listening to others positions and interests first rather than by our own and then ends with a possible consensus. As to negotiation, it should be based upon the five external standards to resolve conflicts and settle disputes--they are 1) Legal Documents, 2) Precedents and Antecedents, 3) Market Price, 4) Third Party Intervention (e.g. mediation and arbitration), and 5) Professional Testimonies if we really want to perform the Integrative Negotiation instead of the Distributed Bargaining--the former would very probably lead to a win-win outcome, while the latter to a zero-sum deadlock. Are we using them? To me, no matter it is a pure lily, or a bright sunflower, or a sweet carnation, which is all created by God with His powerful hand and His miraculous law to decorate this world with beauty and order. Shouldnt we as human beings follow this legitimate way to look for justice and order on earth by getting along with one another and respecting one another within the law we have made by obeying, honoring, and sustaining it through our genuine love and care we deserve? I sincerely wish that every party involved could close the deal at present with bravery and wisdom, choosing the right (CTR) in communicating and negotiating.
