State defiant on new Land Act ‘not satisfied with compensation package’ Kolkata 23 July: With the state government yet to implement the Land Acquisition Rehabilitation and Land Resettlement Act 2013, of Centre, the state law minister Mrs Chandrima Bhattacharya has written a letter to the Centre urging them to convene a meeting with the group of ministers ~Union urban development and law minister ~ before giving its consent. A few weeks back, the state law minister Mrs Chandrima Bhattacharya has shot a letter to the Centre seeking a date for convening a meeting with both the urban development and law minister as the state government was not satisfied with the compensation package that was supposed to be offered to the land losers. Senior officials of the state government added that according to the provisions of the Act , each state government has to offer double compensation from the market price for the land losers in the rural areas, than those in the urban areas, but the state government was not in favour of providing double compensation to all the land losers of the rural areas. In fact the state government has decided that if the land is available from the land losers staying 120 kilometers away from the urban area, then the state government will provide double compensation, other wise the compensation amount will be same as the market price. According to the state government, the rural areas should be divided and based on distance; the compensation package should be fixed. Although a compensation proposal has been formulated by the state government, but before Cabinet approval, the consent of the Union ministers are to be taken as its a Central Act. Howevever this has triggered controversy, as two states Bihar and Maharastra has already implemented the Act by providing double compensation for those staying at the rural areas. Sources in the state government added that till now they have not received any intimation from the Union ministers about their willingness to convene meeting with the West Bengal government, over implementation of the Act. Mrs Bhattacharya admitted that they are awaiting Centres nod for holding a meeting with the state government over this issue. The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 has provisions to provide fair compensation to those whose land is taken away, brings transparency to the process of acquisition of land to set up factories or buildings, infrastructural projects and assures rehabilitation of those affected. sns
