THE JONES ACT Puerto Rico is challenging the essence of the Jones Act, the U.S. build requirement for vessels. HB 2838 requires the safety requirements be maintained for merchant seamen as provided by law and the United States Coast Guard. Alaska and Hawaii are the two other non-contiguous states impacted by the Jones Act. HB 2838 faces a long Congressional process. There are many complex questions that need to be answered, many that radiate beyond economic reasons, many that involve policies and regulations that have been developed and established by governmental regulatory agencies and the Department of Defense. While we in Hawaii are impacted by the Jones Act, it is well that our Congressional delegation reserve decision until all the facts are presented.
