Thank you Leah for this LIVESTOCK AT LARGE BY-LAWBE IT RESOLVED THAT THE FOLLOWING BB AND THE SAME IS HEREBY ADOPTED AND ENACTED AS A BY-LAW OF THE MUNICIPALITY OF THE DISTRICT OF WEST HANTS.LIVESTOCK AT LARGE BY-LAW1. This By-law may be cited and shall be known as the Livestock At Large By- law.2. In this By-law:(a) Livestock means cattle, horses, ponies, mules, donkeys, sheep, goats, pigs, foxes, minks, geese, turkeys, hens and domestic fowl;(b) Municipality means the Municipality of the District of West Hants;(c) Owner includes any person who possesses, has the care of, has the control of, or harbours livestock, and where the person is a minor, includes a person with the custody of the minor;(d) Pound, for the purposes of the Municipality, shall mean a pound set up by the Municipality or, if no pound is set up, the places designated by the Municipality or by the Clerk of the Municipality for the impounding of livestock; (e) Pound Keeper means a person appointed by Resolution of Council as the keeper of livestock or, in the absence of any such Resolution, the Municipal Clerk.3. The owner of livestock shall prevent his livestock from going at large.4. The owner of livestock which is suffering from an infection or contagious disease shall:(a) prevent it from leaving his premises except under effective control, or (b) prevent it from herding with non-diseased livestock.5. The owner of livestock shall pay to the pound keeper the following fees(a) For impounding one or more cattle, horses, ponies, mules or donkeys, the sum of Twenty-Five Dollars ($25.00) per animal;(b) For impounding one or more sheep, goats, pigs, foxes, and minks, the sum of Five Dollars ($5.00) per animal, and for geese, turkeys, hens and other domestic fowl, the sum of Two Dollars ($2.00) per bird;(c) For drafting each advertisement, the sum of Two Dollars ($2.00);(d) For drafting each notice given, the sum of Two Dollars ($2.00);(e) For necessary travel, per kilometre each way, the sum of Twenty-Nine Point One Cents (29.1 C); (f) For the maintenance of the following animals:(i) For each head of cattle, horses, ponies, mules or donkeys, the sum of Seven Dollars ($7.00) per day per animal;(ii) For each sheep, goats, pigs, foxes, and minks, the sum of Three Dollars ($3.00) per day per animal, and for geese, turkeys, hens and otherdomestic fowl, the sum of One Dollar ($1.00) per day per bird.(g) For trucking expenses in connection with the carrying out of duties pursuant to Section 5(a) and Section 5(b), the sum of Fifty Cents ($0.50) per kilometre each way from the place of confinement or capture to the nearest pound.6. (1) When a person finds stray livestock on his land and the owner of the livestock is unknown, he may confine the livestock in any suitable manner.(2) The owner of land confining the livestock shall forthwith, if the livestock is not claimed within forty-eight (48) hours, transmit to the Municipal Clerk a sufficient description so that the owner of the livestock can identify it, together with an indication of the time and place where the livestock was found and the location where the livestock is detained.7. The Municipal Clerk, upon receiving the information referred to in Section 6, shall cause a notice to be posted and published in the manner provided in Sections 9 and 10 of the Fences and Detention of Stray Livestock Act.8. If the owner claiming the livestock does not notify the Municipal Clerk and pay the costs of advertising and of the detention, then upon compliance with the provisions of Section 9 and 10 of the Fences and Detention of Stray Livestock Act, the Fences ArbitrationCommittee of the Municipality shall by order in the manner provided in Section 10 of the Fences and Detention of Stray Livestock Act direct the sale or other disposition of the stray livestock.9. It shall be the duty of the pound keeper, if the name and address of the owner of any livestock impounded be known to him, to serve such owner with a copy of the notice posted by the Municipal Clerk as provided by Section 7 herein, forty- eight (48) hours at least before the time of such sale, either personally or by leaving the same where he resides in the Municipality or by enclosing the same in an envelope addressed to such person, postage prepaid, if he resides outside the Municipality.10. No person shall break any pound or, by indirect means, deliver any livestock therefrom.11. The pound keeper shall not be responsible for any injury or death to any animal and fowl while impounded.12. Any person who fails to comply with any provisions of this By-law for which no penalty is expressly provided shall be liable, on conviction, to a penalty of not less than One Hundred Dollars ($100.00) and not more than Five Thousand Dollars ($5,000.00), and in default of payment, to imprisonment for a term not exceeding ninety (90) days.I, Dwight M.
