The Amador County coroners office determined Durans death was a suicide, and that he died by asphyxiation. State lawyers say the death initially was investigated as a potential suicide, but two doctors who reviewed the case file for the prison agency considered it to be accidental. Lawyers representing state prison inmates say the state hid the case from them during the pepper spray hearings, while presenting experts who testified pepper spray causes no lasting physical harm and is safer than other methods to control unruly prisoners. They, and Durans family, say they did not become aware of Durans death until January, when they were contacted by reporters for the Sacramento Bee inquiring about the case. Lawyers for the state on Thursday told Karlton they were willing to discuss details of Durans death privately, and brought Californias top prison officials with them to court to do that. The department has taken this inmates death extremely seriously from the beginning, said Patrick McKinney with the state attorney generals office. Karlton refused the offer and advised McKinney to take the corrections departments explanations with caution. Let me point out this, if it were your family member this person murdered, raped, robbed or whatever crime was committed, would you be so sympathetic? No you couldnt and Chingis Con you are correct in saying no where does the law say you can pepper spray a crazy prisoner and being incarcerated its obvious this man has no regard for the law. But no where in the law does it say that a crazy man (your words) can assault another human being, rob, steal or whatever this man did that sent him to prison. If he was crazy or had mental issues, why didnt the family step in before he landed himself in prison? Why didnt the family rally together to get him the mental help that he may have needed? What I find sad is that you can bet his family will be there now if they think lawsuit money is a comin.. If society would worry more about the rights of victims instead of those who choose to violate ones rights, maybe our prisons wouldnt be so damn full. This man was on suicide watch, he wanted to kill himself and it seems to me the inevitable happened sooner than later, which in the long run saves you and I tax dollars on housing and feeding a man that didnt want to be a part of society nor did society want. Bags of incoming US mail have been found in the dumpsters. One Sgt Lorenzo Perez, head of the internal investigations, conficates prisoners mail for harassment purposes. Adrina, communications officer at Gov Jerry Browns office, says prisoners have no right to mail, and even if it is arbitrarily confiscated or thrown by bags full in the dumpster, that is no problem. The US Postmaster General said stolen mail is not a concern of the Postal Service. Planning a Ukrainiaan style protest since nothing seems to matter to anyone on salary at taxpayer expense.
