The City of Swan have prepared a report for TOMORROWS Ordinary Council Meeting on Wednesday October 16, 5:30pm, Council Chambers of the Midland Town Hall, you are encouraged to attend and ask questions of the council. Of note from the report; KEY ISSUES The City has received an application for a disability justice centre at Lot 11943 (No.130) Lord Street, Caversham. The property is also known as Reserve 43132 for the purpose of residential and administrative centre. The subject land is zoned Swan Valley Rural under the Citys Local Planning Scheme No.17 (LPS 17) and Rural under the Metropolitan Region Scheme (MRS). The WAPC has declared a Planning Control Area over the subject site. Under LPS 17 the proposed land use falls within the use class definition of Corrective Institution which is an X use within the Swan Valley Rural zone. The proposal is a public work and as such does not require planning approval from the local government, but does require approval from the Western Australian Planning Commission (WAPC). The application has been forwarded to the WAPC for their determination; however, the City acknowledges the opportunity afforded by section 6(3) of the Planning and Development Act 2005 to comment on this proposed public work. At the conclusion of the advertising, three hundred and eighty two (382) submissions were received from residents, with five (5) non objections, and three hundred and seventy seven (377) objections. Concerns raised in the submissions related predominantly to proximity of the facility to schools and residential land, safety and potential increase in crime and antisocial behavior, possible negative impacts on property values and lack of consultation. Two submissions of non-objection were received by government agencies. One submission was received from the Town of Bassendean. It is considered that the proposed land use is not consistent with the objectives of the Swan Valley Rural zone, and furthermore is a land use that is not permitted within that zone.
