The Court of Appeal sitting in Jos, Plateau State has set aside the judgment of the Bauchi State High Court which reinstated the erstwhile Deputy Governor, Muhammad Garba Gadi, asking him to pay N30, 000 as cost to the appellants. The verdict delivered by Justices Oyebisi Folayemi, Ibrahim Shata Boliya and Peter Olabisi Ige on July 26, 2013, followed the appeal against the ruling of the High Court delivered on June 25, 2010 which declared the removal of the then Deputy Governor, Garba Gadi as unconstitutional, null and void. Copies of the judgment which were released to newsmen in Bauchi by the Chief Press Secretary to the governor, Ishola Michael Adeyemi, reads in part: ‘Three issues were placed before the Court of Appeal. All the three issues were resolved in favour of the appellants, in other words, the appeal has succeeded.’ The Court of Appeal also stated that, “the judgment of the Bauchi State High Court delivered on June 25, 2010 is hereby set aside. Respondent, (Alhaji Garba Gadi) shall pay costs of N30, 000 in favour of the appellants.” The implication of the appellate court’s verdict is that all the orders made by the Bauchi State High Court have been set aside; the seven-man panel and the process of the removal of Alhaji Gadi have been declared to be valid, proper and lawful.
