The Haitian government forcefully influences elections. This leads to constant frauds and relentless violations of political freedoms. Such influences occur because the electoral process is centralized by which the government appoints members to the Permanent Electoral Council (PEC), which is an administrative agency representing the government throughout the country through the formation of Department Electoral Bureaus (BEDs) and Communal Electoral Bureaus (BECs) and whose members are chosen directly by the PEC. The current system is a one-size fits all regulatory regime, which renders it almost impossible for the PEC to be independent and autonomous let alone to remain impartial. Perhaps a study proposing a change in policy, where the electoral system would be decentralized to leave the organization of elections up to the territorial divisions might create the PEC’s independency and the autonomy as is it prescribed by Art 1.1 of the Electoral Law of 2013. It would also reduce government interferences and hence, election riggings, vote irregularities, and vote manipulations. This research explores the Haitian electoral process and the powers of the President in such process. It is found that the centralization of the system is at the root of all electoral frauds and hence recommends a change in policy to decentralize the system.
