The National Working Committee (NWC) of the Peoples Democratic Party (PDP) has declared that Comrade Tony Nwoye remained its governorship candidate for the Anambra State governorship election in spite of a court judgment, restraining it. Honourable Justice S. Aliyu of a Federal High Court in Port Harcourt in a declaratory judgment had ruled on Tuesday that the runner up in the PDP Anambra governorship primaries, Nicholas Ukachukwu, was the party’s candidate for the November 16 election. Ukachukwu had filed a suit, asking the Court to declare him as the party’s candidate. Joined in the suit were, the party’s acclaimed candidate, Tony Nwoye (1st defendant), the PDP National Working Committee (2nd defendant), its national chairman, Bamanga Tukur and the Independent National Electoral Commission, (INEC) as third and fourth defendants, respectively. In the judgment given by Honourable Justice S. Aliyu, he declared that the party’s candidate, Tony Nwoye, “was not eligible to participate and or take part in the gubernatorial primary election conducted on August 24, 2013 by the second defendant for the selection of its candidate for the Anambra State governorship election scheduled to hold on November 16, 2013 or any other date.” The court also granted an order of injunction, restraining “the first defendant from parading himself and or representing or holding out himself as the candidate of the second defendant in the forthcoming Anambra governorship election or otherwise representing that he was validly elected/chosen by the second defendants as its candidate for the Anambra governorship election scheduled to hold on November 16, 2013 or any other date.” Justice Aliyu further granted an injunction, restraining INEC from recognising or acting upon any name other than Nicholas Ukachukwu as the PDP candidate for the Anambra governorship election. The declaratory judgment also compelled INEC to recognise, screen, publish and put the name of the plaintiff in the suit, Nicholas Ukachukwu, on the ballot paper as the PDP candidate for the Anambra governorship election. But reacting to the judgment yesterday, national publicity scribe of the party, Barrister Olisa Metuh, declared that Comrade Tony Nwoye would fly the party’s banner at the November 16 governorship election, even as he gave indication that PDP would appeal the judgment of Honourable Justice S. Aliyu. “The candidate of the party in Anambra State is Comrade Tony Nwoye and his deputy gubernatorial candidate filed with INEC is Dr. Ezike Amachukwu.
