The Nigerian Constitution is a KNOTTY and perhaps NAUGHTY one. The interpretation of it should be STRICTLY left to the COURTS. There are perhaps more than a few questions (and answers). Q. Why does Section 68(1) apply to members of the House of Representatives but not Governors? A. Section 68 (1) is SPECIFIC to members of the National Assembly. It is NOT applicable to Federal or State Executives. Q. Is it in order to call for the resignation of the Speaker of the House of Rep. ? A. Unfortunately, the Constitution of the Federal Republic does NOT mention resignation with regard to members of the National Assembly. Technically, the Speaker cannot resign. He can only be removed by a resolution of the House, or otherwise if he ceases to be a member of the House, or if the House is dissolved. But there is NO provision for the RESIGNATION of a member or SPEAKER of the House in the Constitution. There may be such provisions in the House Rules, but such provisions should be subject to the constitution. Q. Can the Inspector General of Police or the President of the Federal Republic give effect to Section 68(1) of the Constitution? A. Section 68(2) specifies who gives effect to Section 68 (1). The person so specified is the Speaker, not the IGP or the Executive. Q. why does the Constitution envisage death, resignation and infirmity in regard of the Federal and State Executive but does not so envisage in regard of members of the National and State Assemblies? A. Hmmmmmmmmmn!!!! I beg your pardon, but who been draft the Nigerian constitution sef? Abi na daft dem daft am? Q. Lol. Is the Constitution of the Federal Republic therefore seriously flawed? A. Well, flawed and serious flawed are related. However, the degree of seriously is a subjective argument. Q. You are answering like a politian. Are you one of them? A. Haaaaaa. You just insulted me.
