The Shariah (Islamic Law) provisions in the FAB, CAB and the draft Bangsamoro Basic Law do not constitute the first time that Shariah provisions are provided in Philippine law. As early as 1977, the Code of Muslim Personal Laws, already mentions the Holy Quran, Sunnah and other sources of Islamic Law in connection with interpretation of Shariah legal provisions. This legal methodology is now being used by our Shari’ah District and Circuit Courts which handle Muslim family cases in Mindanao. The same provision is repeated in R.A. 9054 or the Organic Law for the ARMM. These provisions have not been abused by our Muslim brothers and sisters who have turned to these laws for legal recourse. This is the essence of a legally pluralistic society --- of which the Philippines is one --- recognizing as it does Civil Law, Islamic Law and Customary Law as co-existing in the Philippine legal system.
