The Tories want to scrap the Human Rights Act to give British courts the ultimate authority in deciding whether laws the government have made breach peoples human rights. Courts in the UK follow a system of soft judicial review, which means that unlike (frex) America, where judges can strike down laws that are unconstitutional, the most the courts in the UK can do is tell the government that the law breaches peoples rights. Theres no way for them to change that law or compel the government to change it. The only way to get them to change it is with the involvement of the ECHR. They want to remove the only safeguard that forces them to give you any rights. Happy Friday!
