Initially news of the collision first reported by the NY Post was conveyed in a way that laid all blame on Mr. Marshall, did not report his injuries, made him out to be a monster whose negligence caused the collision, and mentioned only in passing that there was a question as to who had the green light. Using words like “barreling”, “slammed into,” and quoting cyclist-haters as sources, the NY Post set the stage right away for trying and declaring guilty the cyclist in the media, before a charge was even made. The Post also incorrectly reported that Mr. Marshall had been riding a bicycle with no brakes, an indication that none of the reporters had ever ridden a bicycle seriously, or know little about bicycles. The Post and the NY Times also greatly exaggerated Mr Marshall’s speed, as he was traveling in the downhill section from Tavern on the Green along the West Side Drive, using witness statements describing his speed as “fast.” The Jamis bicycle, reported to cost about $4,000 was a regular road bicycle that had been outfitted with aerobars, and the bicycle did have brakes. Our witness who had been riding along with Mr. Marshall in Central Park that day reported that he was “not a fast rider,” but rather riding at a recreational speed. the downhill section would naturally have caused Mr. Marshall to travel faster. It was not clear who had the green light at the time of the collision or whether Mr. Marshall had time to stop given the distance between himself and Ms. Tarlov.
