In several Supreme Court cases, including Ex parte Garland (1867) and Klein v. United States (1872), the Supreme Court of the United States ruled that the power of the President to grant “reprieves and pardons” cannot be regulated by Congress. In Ex parte Grossman (1925) and in other Supreme Court cases, the pardoning powers of the President are deemed to be absolute. Congress has nothing to do with Presidential pardons unless the President interferes with an ongoing impeachment (which Ford did not do, because at the time Ford pardoned Nixon, Nixon was out of office and had not been impeached) or unless the President attaches conditions to a particular pardon which he designates as subject to Congressional action. (As you might have guessed, the only two Presidents who did not live until their first Thanksgiving in the White House, and thus never granted a single pardon, are William Henry Harrison and James A.
