The fact that Benton Mackenzie was being tried for this offense is a travesty. Based on the headline this may appear to be a victory for medicinal Cannabis and in some respects that may be true. The judge did disregard the mandatory minimum sentence that he truly has no ability to use personal discretion, but he did it anyway. That is noteworthy. However, if you look more closely you will realize that it was the trial itself that was getting a great deal of attention from the press and activists. Had Mr. Mackenzie been convicted, this story would have received even more attention. So what did the Judge do? He gave him probation with the caveat that if Mr. Mackenzie continues to use Cannabis, the one medicine that provides him relief, that he would then be in violation of his probation and the mandatory minimum sentence would be imposed. What this means is that the Judge can say I showed compassion and Mr. Mackenzie ended up going to prison because he was unable to abide by the laws of Iowa and with my guidelines. Lets be realistic here; Benton Mackenzie will not stop using Cannabis if that is what is keeping him alive and shrinking his tumors. As a result he will violate the terms of his probation and more likely than not he will be incarcerated because of the violation. What will not happen is the press will not be involved and the activists will not be there to rally around him. In the eyes of the press this story ended yesterday with the sentencing. When Benton Mackenzie is arrested and taken to jail immediately, it will be with little fanfare and almost no way to avoid it. All that happened yesterday was a back door incarceration that allowed the Judge to save face and pacified those of us that are outraged. This story is not over. The next chapter is the one to watch.
