TAMAN SRI GAYA RESIDENTS ROBBED OF TADIKA LAND A group of parents of students studying at SK Sri Gaya and some residents of Taman Sri Gaya met DAP LIKAS Assemblyman Junz Wong on a site where the Mayor Dewan Bandaraya Kota Kinabalu (DBKK) is alleged to have recently approved a “posh” 30 storey condominium building. The building site and approval has met with controversy because the group claim the land was alienated for a Tadika and was also zoned for an Education Facility in the City’s most recently adopted Local Plan. LAND TL 017537503 Mr Mohan Singh, Parents & Residents joint action committee chairman, has elaborated on the land ownership controversy by showing the latest land title deed obtained on 14 March 2014 at Land & Survey office. Land title clearly specified that the purpose of the land is solely meant for Tadika national. Title deed also shows that the ownership of the land still belongs to the trustee of Tadika national. Mohan said thus raising issue how could the developer use the land for proposed condominium project. NO PUBLIC CONSULTATION KK City’s residents are aware that there must be public consultation with the residents before development is approved which is in Town and Local Plans which DBKK and developers need to comply with. However there is no meaningful proper public consultation ever done with the residents of Sri Gaya and surrounding Tamans. This is not only in terms of land use but also in terms of height, scale, parking requirements, roads, drainage, environment, consultation and so on. Mohan elaborated MAX HEIGHT AT 49M Residents are also confused as to why local authorities could approve the condominium project at 30-storey when under section 8 Civil Aviation Act 1969 Aerodrome (controlled area) Order 1982, plan no:99197165 has clearly limited the maximum height at 49M. 30-storey approval has clearly violated the maximum height limit which could cause danger to flights. ADJOINING LAND CL 017546280 Mohan also asked about the status of the adjoining land titled CL 017546280 because its apparent that the construction site of the said project has encroached into the adjoining land which is solely meant for open space via football field purpose. Has this piece of land also sold or transferred to the project owner for condominium development?! Mohan asked. PUBLIC CONCERNS Residents raised concerns whether or not relevant Ministries & authorities have done studies to understand the impact which would affect the Taman Sri Gaya residents and students of SK Sri Gaya. Are the existing roads and services capable of handling additional traffic and demands on infrastructure? Mohan asked. HIEW NOT HELPING Residents have regretted that Luyang assemblyman Hiew King Chew has failed to represent the voices of his voters when he earlier on issued statement to support this project development. 1) Why did Hiew go meet up the developer alone without any residents nor representatives of parent teacher association (PTA)? 2) Why Hiew did not consult and care to hear the grouses of the residents and PTA before and after. 3) When Hiew mentioned processes & approval, why he did so without identifying each and every single process, approvals? 4) Why He did not take into consideration the impending loss of a site reserved for Tadika and the necessity for government to find a replacement site. 5) Why He has failed to explain how the trustees could sell the land, to who and for how much. DIALOGUE TO BE HELD Mohan announced that they have sent out official letters to all relevant authorities and government departments for invitation to attend a dialogue session with the residents, parents-teachers association and other stakeholders on 4 April 2014 at 2pm. It will be held at SK Sri Gaya School hall. This is done in goodwill and a good gesture that hopefully all relevant personnel will attend to explain to the residents how the decision to grant approval for the said condo project was reached. Mohan urged attendance failing which the residents will have no choice but to seek legal means for solution. AUTHORITIES MUST CLARIFY When asked to explain his role Junz Wong said he was approached by some parents and residents associated with SK Sri Gaya and Taman Sri Gaya who believe a Tadika is the best use for the land and it is something which will benefit KK City as a whole. He also advised that the government departmental heads and Ministers to come forward and explain what information they had looked at before deciding a 30 storey condominium in this location is acceptable and also a better use than a Tadika for the land. If the parents and residents are happy with their explanation then I will have done my job as a Wakil Rakyat. The relevant ministries must be brave enough to come forward and defend the decisions they have made. If they are convinced the project is legal and good for the community, whats there to hide?
