The seatbelt defense is not allowed in North Carolina. It is interesting to note that Walmart is trying to shift the responsibility for Tracy Morgans injuries to him by claiming his injuries were caused by his failure to wear a seatbelt. North Carolina requires all vehicle occupants to wear a seatbelt however, failing to wear a seatbelt cannot be used to suggest someone would not have been injured, or their injuries would not have been as severe - no evidence concerning the lack of seatbelt use can be introduced at trial.
