There is misperception that being a signatory to the ICC undermines the sovereignty of Kenya and that the court targets Africans is misplaced. The sovereignty of the country is not pegged to the ICC. Detaching ourselves from the ICC would only be okay if the country has the ability to function independently and with their own interests and ideas at heart. However, in a country like Kenya where leaders have access to military technology, and they are able of frightening efficiency of the court and influence the decision of the domestic courts, the way that these independence can be tamed is essential. Being a signatory to the Rome statute is a significant step towards prohibiting future atrocities like the one experienced in 2007/2008. Kenyans should understand that the court does not target persons. The court is created in order to protect the victims of the most serious and heinous crimes. The reality is that atrocious human rights abuses and other serious crimes that merit the ICC’s attention have and continue to be committed in Africa.
