ILONGGO AND TAGALOG versions can be POSTED upon request. ________________________________________________________________ Yesterday we tackled examples of how the Constitution impacts our lives as a people, with all the other elements of a State such as territory, sovereignty and police power. I hope that I have began to establish a link on the application and effect of the fundamental law (our constitution) to us, the people. As discussed yesterday, the 1987 Phil. Constitution provides for the territorial and political subdivisions of the Republic of the Philippines, defining them as provinces, cities, municipalities and barangays. (Sec. 1, Article 10). Section 2 of the same provides that each local government unit (LGU) shall enjoy local autonomy thereby empowering the then insignificant barangays into one of the local governments with autonomy. Further, Section 3 of the same Article 10 in our Constitution provides that Congress shall enact a local government code (law) which shall provide for a more responsive and accountable local government structure instituted through a system of decentralization with effective mechanisms of recall, initiative, and referendum, allocate among the different local government units their powers , responsibilities and resources, and provide for the qualifications, election, appointment and removal, term, salaries, and all other matters relating to the organization and operation of the local units. The Local Government Code of the Philippines (R.A. no. 7160) was enacted into law in 1991 pursuant to this constitutional mandate. The main author of this law was Aquilino Pimentel, Sr. It is the President of the Republic of the Philippines who exercises general supervision over local governments through the DILG (Department of Interior and Local Government) administered or as in private sector parlance, managed by the Secretary of the DILG as the President’s alter-ego in that area of responsibility. Hindi makaya ng isang tao lamang ang mag manage ng buong executive department na sakop ang lahat ng serbisyo para sa, at pangailangan ng, taong bayan. Therefore, in seeing to it that the public is given health services that include among others their protection from epidemics, implementation of programs to secure better health services rendered to the people, the availment of free medical care by indigents, and many others, there is the Department of Health headed by the Secretary of Health to take charge. And the list of all other departments acting for and in behalf of the President as the Chief Executive of the Executive Department goes on to include a Department each for national defense, labor, education, tourism, commerce and trade, foreign affairs, natural resources, agrarian reform, agriculture, energy, transportation and communications and justice. I may have not included some departments but then, this is for purposes of information and basis for analysis of the state of our government today. Saan dito ang local governments na tinalakay natin kahapon sa 2nd part nitong pag-aaral natin n gating Gobyerno? Nasa ilalim po ng Department of Interior and Local Government. Ang lahat ng mga probinsya, cities, municipalities and barangays are under the supervision of the DILG. Aside from these political subdivisions (review the 2nd part of this ON LINE articles on the fundamentals of our government) in Section 1 Article 10 of our Constitution, under supervision din ng DILG ang Philippine National Police, The Bureau of Fire Protection and the Bureau of Jail Management. It is thus safe to say that a high public official of our republic with a cabinet portfolio in the over-all management of effectively all the LGU’s and the three bureaus on police, fire protection and jail management & penology, is an under-study for presidency of the republic. The enormity of responsibility placed on the shoulder of the Secretary of the DILG clearly requires competence and experience. This is only ONE part within the structure of our government my friends that by itself alone already has tremendous impact or effect on us citizens and non-citizens alike, the latter as residents or transients in our land, to be protected both by our municipal and international laws. Eh ang dami pa as I have enumerated above. I stated in the first part of this Series of Articles on Phil. Government, that we must LEARN, KNOW AND UNDERSTAND FULLY the fundamentals of our government para naman di na tayo kulang sa kaalaman at basta na lang nakikinig at umaasa sa kaalaman na binibigay sa atin ng mga kinaukulan sa kanilang paniwalang wala tayong tiyaga alamin ang mga bagay or knowledge that the learned, the public officials, those in the legal profession believe have monopoly of. So tomorrow, again, we tackle the Constitution for more understanding of our government operation and structure.
