This is a cake I made back in July for the bakery where I worked in Atlanta. The customer emailed us a pic and because the quality was so bad I had to search on the internet to find the original. I did find it and was able to recreate this cake because that is what the customer wanted. My question is this. When you work for a bakery and are asked to recreate other peoples work and designs, should I, as a decorator try to get permission to do that from the original designer? When I am asked to recreate licensed characters such as Minnie Mouse, can I be sued for copyright infringement if I worked for someone else while doing it? I have done cakes for over 30 years and I dont expect the copyright police (lol) to show up, however, I may start teaching at a college soon in the continuing education program and that may include a certificate program. I feel like I need to have definitive answers to these questions so I can instruct my students in how to protect themselves and how to handle employers that ask them to duplicate others work or break copyright laws. Not asking for legal advice here but just wondering how other folks handle this and if someone KNOWS the legalities of it, if they would mind sharing. Thanks!
