This is to let you know that the decision on Kinder Morgans application for an injunction will be delivered by e-mail tomorrow morning. This is somewhat unusual and there is speculation about what this means. The following are simply my guess at what this might mean. It could simply be to prevent a reaction at the court house. It would seem, however, that if the judge was going to grant the injunction he would first ask for submissions about the conditions of the camp and how long it would take to clear the area to enforce an order. But delivering the decision by email, could mean that the judge is going to rule that the NEB should decide, or that there is insufficient basis for the Judge to rule. However, if the judge rejects the application for an injunction or sends it to the NEB to decide, Kinder Morgan could simply submit a Notice of Motion for an injunction to the NEB against occupants/protestors an the NEB would probably expedite a hearing. In all likelihood Kinder Morgan has their Notice of Motion for the NEB ready to submit tomorrow and that the NEB will grant the injunction within days, if required. Arrests could then begin next weekend or a little later if people decide to block Kinder Morgan contractors from work and thereby commit contempt of court and civil disobedience. In any case, this is a long term struggle and we will continue to mobilize and strengthen the democratic process so that people not corporations can decide on our future.
