Basically, Texas Code says you cannot select the architectural firm.who will design.procure and construct these.projects based on competitive bids. They must first select the most,highly qualified provider of services on the basis of demonstrated competence then ATTEMPT to negotiate with that provider a.contract at a fair and reasonable.price. the decision is made by the board of trustees. It gets much more detailed in how fees can be negotiated, etc. So basically, architects and engineers lobbied your reps and they voted to make it possible for you to be at the mercy of these firms in construction. When the school district goes to evaluate.pricing against the engineers estimates for.construction.,the basis for comparison is against projects those firms have built for.other government institutions, not what the.private.sector market is experiencing in terms of competitive market work or private sector costs for.material.or labor. . I have some ideas on how to break this down into smaller bites for.people that are not from.a.procurement background, but cant do it right this minute. I will post links as soon as i can. Basically,,I see what has happened as a very crafty way to corner a market with means that I stop.short.of calling price fixing. A business owner in the private sector furnishing services to private sector money would be under a great deal of anti trust scrutiny for what has been set up here. I know it.is all for the.children, but as Cyndi Martin Lawrence says, we are loving our children to.debt.
