This story has attracted a lot of attention this week, all thanks to the Charter of Values debate. While I dont agree with how this photo was used, i.e. to promote hatred and put people in danger, some misinformed people claim the photo is illegal because the photographer didnt obtain the parents permission to use the image. Wrong! This was taken in a public place, where we are all reasonably free to photograph whatever we see. No one is trespassing; no one is breaking any privacy laws. In all those years as editor-in-chief of the Westmount Examiner (when it was a good paper!), I had final say on what photos we ran, and we ran photos just like this all the time --- in fact Id hate to think of how badly restricted we would have been if we had needed parental permission before publishing photos of any minor in public. Think of kids at a hockey game and you get the idea of how press laws help the media do their job. But when an image is used this way --- forget it!
